RULES FOR SERVICES IN THE “ACCOMMODATION (ACCOMMODATION FACILITIES)” CATEGORY

Last updated: 01.09.2026

These Rules govern the use, on the Digital Platform, of functions for searching, selecting and booking Accommodation Facilities and, where applicable, Tour Packages that include accommodation (the “Accommodation Service”). By using the functionality of the Accommodation Service, the User confirms that they have read these Rules and agree that they apply, together with the applicable provisions of the User Agreement and the Privacy Policy. A contract relating to a specific paid Order is concluded separately in accordance with the Public Offer for Clients, the terms of the Order and the acceptance action provided for in the interface.
1. Terms and Definitions
1.1. Company or Pathrest means Pathrest LLC.

1.2. Digital Platform means the Website operated by the Company, its subdomains, the Personal Account and related software functionality.

1.3. Website means www.pathrest.am, including its subdomains.

1.4. User means any person who visits the Digital Platform or uses its functionality, irrespective of whether that person is registered or places an Order.

1.5. Customer means a person who makes a Booking or places an Order for their own benefit or for the benefit of Travel Participants.

1.6. Travel Participant / Guest means a person for whom the Accommodation Service is ordered.

1.7. Accommodation Facility means a hotel, guest house, apartment, aparthotel, rental house or private house, or another similar facility that provides temporary accommodation.

1.8. Accommodation Supplier / Supplier means a person that actually provides the Accommodation Service, arranges its booking or supplies the technology supporting it, including an Accommodation Facility, owner, management company, tour operator, booking system or host party.

1.9. Partner means a person that lists an Offer on the Marketplace or cooperates with Pathrest under another contractual model.

1.10. Offer means the set of terms presented on the Digital Platform in relation to a specific Accommodation Facility or Tour Package.

1.11. Booking means the Customer’s request to receive a service under the selected Offer. Order means an identified transaction whose material terms have been established and, where applicable, confirmed in the relevant system.

1.12. Confirmation / Voucher means an electronic document or message confirming the status and material terms of the Booking, including the Accommodation Facility, dates, composition of the Guests, included services and cancellation rules.

1.13. Tour Package means a combination of tourism services that may include accommodation and other services, such as air carriage or a transfer. Not all Offers presented on the Website are Tour Packages.
2. Accommodation Service models and the role of Pathrest
2.1. Pathrest provides the User with the information technology functionality to search, compare and select Offers for Accommodation Facilities and/or Tour Packages and to make a Booking.

2.2. Depending on the specific Offer, the Accommodation Service may be provided:
(a) through an external Supplier or tour operator, with Pathrest acting as an intermediary/agent;
(b) by an Accommodation Facility or Partner that lists an Offer on the Marketplace;
(c) on an external platform under an affiliate/redirect model;
(d) by Pathrest as its own service or as a contracting party, where this is expressly stated and the necessary grounds exist.

2.3. A Booking may be made on the Digital Platform manually or through an API with subsequent confirmation in the Supplier’s system, in a fully integrated flow or after a redirect to an external platform. The technical processing method does not in itself diminish the Customer’s rights.

2.4. Before the Order is confirmed, the Customer is provided, in an accessible form, with information on Pathrest’s applicable role, the contracting party or actual service provider, the payment recipient/processor, the Booking confirmation procedure and the specific rules.

2.5. If a payment interface is embedded in the Digital Platform, the fact that the Customer remains on the Website does not in itself mean that Pathrest is the payment recipient, merchant of record, the Accommodation Facility or the actual provider of the Accommodation Service.

2.6. The actual accommodation and the quality of the Accommodation Facility are provided by the relevant Accommodation Facility and/or Supplier. Pathrest is responsible for the intermediary, agency, sales, technical or performance obligations it has assumed under the specific Order.

2.7. Internal net rates, commissions and settlements between Pathrest and the Partner/Supplier do not form part of the contract with the Customer unless they affect the final price or the Customer’s rights.
3. Search, Booking and Order confirmation
3.1. The User selects the destination, dates, number of Guests and other applicable parameters and receives the Offers available at that time.

3.2. The Offer card or detailed description may state the type of accommodation, the room/facility option, meal plan, included services, rate, cancellation rules, additional charges and available information about the Supplier. The appearance of the interface may change without reducing the legal information provided.

3.3. Before confirming the Order, the Customer must verify the Accommodation Facility, address, dates, composition and ages of the Guests, accommodation/meal option, included services, cancellation and amendment rules, taxes, deposits and other charges.

3.4. Acceptance of a specific Order is made by an unequivocal action provided for in the interface: selecting a mandatory checkbox, clicking the booking/confirmation/payment button and/or making full or partial payment, depending on the applicable model.

3.5. The Company’s system may record the date and time of acceptance, the Customer and Order identifiers, the version of the applicable documents and technical data necessary to evidence the electronic interaction.

3.6. A Booking is finally confirmed upon receipt of the Confirmation/Voucher, unless the Offer expressly provides otherwise. Initiating payment or accepting the request does not in itself constitute final confirmation where additional confirmation from the Supplier is required.

3.7. The Customer must verify the Confirmation/Voucher received and promptly notify the person indicated for Order servicing of any discrepancies.
4. Price, availability and additional charges
4.1. Until the Booking is confirmed, the prices and availability of Accommodation Facilities may change as a result of dynamic updates to data from external systems or Suppliers.

4.2. The final price, payment currency and amounts payable at that time, later or at the Accommodation Facility are disclosed to the Customer before the Order is confirmed, to the extent available at that time.

4.3. Tourist or city taxes, a deposit/security deposit, cleaning fee, resort fee, late check-in or early check-out fee, additional Guest charge, utility charges or fees for other services provided on site may be payable separately where required by the terms of the Offer or Accommodation Facility.

4.4. The currency conversion rate and external bank or payment fees are determined by the relevant bank/payment system unless expressly stated otherwise.

4.5. The price of a confirmed Order may be changed only in accordance with its terms, as a result of a change requested by the Customer, an additional service actually received on site or on a ground provided by law.
5. Check-in, stay and Accommodation Facility rules
5.1. Check-in and check-out times, requirements for identity or other documents, the key collection procedure, and restrictions concerning smoking, pets, quiet hours, events, children’s accommodation and other matters are determined by the terms of the relevant Accommodation Facility/Supplier.

5.2. The Customer and Guests must comply with the lawful rules of the Accommodation Facility, use the property properly and compensate for damage caused through their fault, to the extent provided for by applicable law and the terms of the Order.

5.3. The Customer must give timely notice of any special requirements, including those concerning accessibility, a cot, a pet, late check-in or other conditions. A special requirement becomes binding only after it has been confirmed.

5.4. If the Accommodation Facility cannot provide the confirmed option, the rules of the Supplier/Partner, the Tour Package and applicable law apply, including any possible equivalent replacement or refund.
6. Cancellation, amendments and refunds
6.1. The availability, time limits and deductions applicable to cancellation, amendments and refunds are determined by the selected rate, the rules of the Supplier/Accommodation Facility or tour operator, the payment model and the mandatory provisions of applicable law.

6.2. A rate may be fully refundable, partially refundable or non-refundable. In the case of a non-refundable rate, a refund may be excluded or restricted to the extent permitted by applicable law.

6.3. A request concerning an Order placed through Pathrest may be submitted to Pathrest through the Official Communication Channels. Processing the request may require confirmation from the Supplier, Accommodation Facility or tour operator.

6.4. If payment was accepted by an external booking or payment system, the refund may technically be processed by that party. Pathrest may receive and process the Customer’s request within the scope of the post-booking functionality available to it and the role it has assumed.

6.5. If the Accommodation Service forms part of a Tour Package, the terms applicable to the relevant component, the relevant Supplier and the Tour Package apply to amendments or refunds for each component. Any right to a refund of the price of an air ticket or transfer is determined by the applicable fare and rules and does not arise automatically.

6.6. Where funds have been accepted by Pathrest, refunds and permitted deductions are processed in accordance with the terms of the Order, taking into account the Supplier’s actual and lawful deductions/costs and the requirements of applicable law.
7. On-site problems, claims and support
7.1. If a problem is identified during check-in or the stay, the Customer or Guest must immediately contact the Accommodation Facility/reception and notify Pathrest as soon as possible, attaching photographs, messages or other supporting materials.

7.2. Late notification may make it more difficult to document and resolve the problem because many issues can be addressed only at the place and time the service is provided. This does not limit the statutory time limits for bringing claims.

7.3. The Accommodation Facility, Supplier, Partner or tour operator may be involved in reviewing a claim concerning the quality of the actual accommodation, within the scope of their respective responsibility. If Pathrest is a party to the contract for the specific Order, the claim may also be submitted to Pathrest.

7.4. Where possible, the request should include the Order number, the Customer’s details, a description of the problem, the remedy sought and supporting documents.
8. Personal data and third parties
8.1. For the purposes of searching, Booking, performing and servicing an Order, the Company may process and, to the extent necessary, transfer the data of the Customer and Guests to Suppliers, Partners, tour operators, Accommodation Facilities, host parties, and payment and technical partners, provided that an appropriate legal basis exists.

8.2. By providing the data of other persons, the Customer confirms that there is a lawful basis for transferring the data and informs those persons of the applicable processing.

8.3. In the case of manual booking, an authorised Pathrest employee may enter the necessary data into the Supplier’s secure system; where the process is automated, the same data may be transferred through an API.

8.4. Details of the processing of personal data and cookies are set out in the Privacy Policy and the Cookie Policy.
9. Force majeure and service availability
9.1. The parties’ liability in the event of force majeure is determined by applicable law, the terms of the Order and the rules of the relevant Supplier, subject to compliance with the applicable notice and evidence requirements.

9.2. The procedure for refunds, changes of dates or the provision of an alternative may depend on decisions made by the Accommodation Facility, Supplier, tour operator and public authorities. Pathrest does not guarantee a refund that is objectively unavailable under the applicable terms and law, but it will perform the obligations imposed on it.
10. Permitted use and automated access
10.1. Without Pathrest’s prior written permission or an API specifically provided by the Company, it is prohibited to use programs, scripts, bots, crawlers, scrapers, parsers, browser automation, artificial intelligence or other automated means for the bulk or systematic collection, copying, downloading, monitoring or reuse of Offers or other data.

10.2. These Rules do not grant any right to resell, syndicate or make Offers or data available through an API. Such B2B/API relationships are governed by a separate agreement.
11. Governing law, amendments to the Rules and language
11.1. The relationship between the User and the Company is governed by the law of the Republic of Armenia unless mandatory provisions of applicable law require otherwise.

11.2. The Company may change the list of Suppliers, Partners and technical integrations available through the Accommodation Service without amending these Rules, provided that the applicable model and material terms are properly disclosed to the Customer before the Order is confirmed.

11.3. The Company may publish a new version of the Rules on the Website, indicating the date of the latest update. The new version applies to use of the Service and to new Orders after it enters into force. An Order that has already been confirmed is governed by the version presented when it was placed, unless otherwise provided by law or agreed by the parties.

11.4. Amendments that require separate consent under law or by the nature of the relationship take effect only after such consent has been obtained.

11.5. The Rules may be published in Armenian, Russian and English. In the event of discrepancies, the Armenian version prevails unless otherwise required by mandatory provisions of applicable law.
